Approaching Constitution Day: 5 Interesting Facts You Need to Know for September 17th!

For the first time ever, America’s most important document has been reassembled for a modern audience in The Constitution of the United States of America: Modern Edition edited by Dr. Henry Bain. Below are five fun and interesting facts about our Constitution that you may or may not (but definitely should!) know:

1. September 17 is Constitution Day.

The late Senator Robert Byrd of West Virginia, a Constitution enthusiast and a skilled parliamentarian, struck a blow for constitutional literacy a few years ago when he slipped a rider into an appropriation act that required an annual celebration of the Constitution by federal agencies and by educational institutions that receive federal funds.

The law requires that on Constitution Day (September 17) every federal department and agency “provide educational and training materials concerning the United States Constitution to each employee.” Furthermore, every educational institution that receives federal funds for a fiscal year “shall hold an educational program on the United States Constitution on September 17 of such year for the students served by the educational institution.”

 

2. Only three errors in the Constitution have ever been discovered, and Dr. Henry Bain himself found one of them.

Congress committed each error as it prepared an amendment for adoption. By “error” this means something that is incorrect and was not intended by the Congress that drafted the constitutional text. Though scholars and lawmakers have been scrutinizing the Constitution minutely for a long time, it appears that nobody had noticed this second mistake until Dr. Bain pointed it out. The error appears in the 17th Amendment on election of senators.

 

3.  The Supreme Court’s little-appreciated role in the repeal of constitutional text.

We all know how text gets added to the Constitution–an amendment is proposed by two thirds of each house of Congress, and approved by three-quarters of the states, as provided by Article V. But what about the opposite process, in which text is removed from the document? That is an important part of the process of constitutional development, but it is nowhere spelled out for us.

The short answer is that text can be subtracted by amendment just as it can be added. That was done in the case of the Twenty-first Amendment, which repealed the Eighteenth (Prohibition) Amendment. But little attention has been paid to an alternative method. The Supreme Court can do the job!

Here two instances of such removal of text by the Court. One of these is the language in the Fifth Amendment that establishes a right for persons accused of crime: they can only be prosecuted if a grand jury votes an indictment or presentment. In fact, we all have a stronger right than this text suggests, because presentments have never been much used, even in the early days of the Republic, and they have been prohibited since 1946 by the federal rules of criminal procedure, approved by the Supreme Court. So no matter how heinous your transgression, you don’t have to worry about a federal prosecutor coming after you with a presentment that he has gotten a grand jury to approve. The Constitution’s mention of them is a dead letter. 

Another example of the Supreme Court trimming the Constitution is in the Twenty-fourth Amendment (1964), outlawing the poll tax, where there is an interesting limitation. The amendment applies only to voting for federal offices: presidential electors, senators, and representatives. To get it adopted, its sponsors had to exclude all state and local offices.

 

4. James Madison tried and failed to secure a well-organized Constitution: the story of the first ten amendments.

James Madison, elected a representative in the First Congress, felt an urgent need to obtain amendments that would guarantee Americans’ basic rights. The task was not easy, since many of the Federalist members of Congress, who were a large majority, thought this a needless distraction from their efforts to get the new government running–establish courts, secure revenue, etc. The anti-Federalists were totally opposed–they were demanding many amendments, but these were attempts to weaken the new national government, not to protect rights. Madison crafted a set of twelve amendments, to be inserted at appropriate points in the constitutional text, and succeeded in getting the package approved in a preliminary vote by the House of Representatives. But the vote was too close for comfort. (In the final vote, a two-thirds vote would be needed.)

In the House debate, a big obstacle to Madison’s project was revealed when Roger Sherman of Connecticut, who had been a member of the Constitutional Convention,  spoke strongly against Madison’s proposal, complaining that it was not proper for Congress to intrude into the text recently composed by the Convention and approved by the states. Any amendments should be placed at the end of the document, he declared. Sherman did not confine himself to speechmaking. When the anti-Federalists asked for a full debate on their numerous resolutions (a project viewed with horror by all good Federalists), he voted with them, and brought another Connecticut member along with him on the vote.

In the face of this tactic, Madison yielded and placed the whole package of amendments at the end of the constitutional text, where they became the first ten amendments.

 

5. As much as 20% of the Constitution is now considered obsolete or no longer used.

While it is extremely important to learn about our history’s past, it is also necessary to learn what parts of the Constitution are and aren’t still in place today.

This widespread obsolescence sometimes affects entire paragraphs or amendments (the Eighteenth Amendment, imposing Prohibition) and sometimes tiny parts of sentences (the language making it clear that the Constitution covers treaties made before 1788). When we have taken account of all the pieces of obsolete text, large and small, we find that more than one-fifth of the document is now obsolete and ready for a museum.

 

Now that the Constitution is accessible, Dr. Bain hopes that students, kids, and even activists and citizens will be able to understand the Constitution in its own words, without the need for commentary or paraphrase.

  • The powers vested in each branch of the federal government
  • The role of the states in our federal system
  • The Amendments to the Constitution
  • The meaning of antiquated terms and grammatical forms
  • The vision that molded our country to what it is today.

Local Maritime Cultures Celebrated At Moompetam, The Aquarium’s Eleventh Annual Native American Festival

Several tribes will be represented at the Aquarium through live music and dance, cultural craft presentations, and artifacts of daily life.

Envision what our region was like several hundreds of years ago and learn about the various tribes that maintain their historical connection to the ocean at the Aquarium of the Pacific’s Moompetam: Gathering of the Salt Water People. The Aquarium’s eleventh annual Native American festival will be held Saturday and Sunday, September 19-20, 2015. This event will feature traditional music, dance, storytelling, cultural craft demonstrations, and educational programs. Families will be able to participate in arts and crafts for all ages as well as other activities inspired by local indigenous maritime cultures. Native American artists will present cultural materials, such as basketry, items of adornment, and artifacts of daily life.

 

Moompetam (pronounced \’mohm peh tahm\), meaning “People of the Ocean,” is derived from the word for saltwater in the Tongva language. For the local, coastal, and island indigenous people of Southern California, the ocean has always been a sacred entity. The maritime native peoples that inhabited ocean waters for thousands of years, including the Tongva, Chumash, Acjachemen, Costanoan, Luiseno, and Kumeyaay, were taught to deeply respect the ocean. The ocean environment is reflected in all aspects of their cultures.

The Transporter Refueled – A Reboot of An Action Series With Mixed Reviews

There are many mixed reviews on this film which opened this weekend. Many people were disappointed that Jason Statham was replaced by newcomer Ed Skrein. The story follows a former special-ops mercenary, Frank Martin, now living a less perilous life – or so he thinks – transporting classified packages for questionable people. When Frank’s father (Ray Stevenson) pays him a visit in the south of France, their father-son bonding weekend takes a turn for the worse when Frank is engaged by a cunning femme-fatale, Anna (Loan Chabanol), and her three seductive sidekicks to orchestrate the bank heist of the century. Our reviewers also had mixed reactions. Tre’ana H., age 11 comments, “The Transporter Refueled is an action-packed, thriller and crime film. The Transporter Refueled

The Transporter Refueled is an action-packed, thriller and crime film. The director Camille Delamarre delivers this spine-chiller in a way that keeps you in suspense the whole time.  Their fashion is sleek and sophisticated.

This film takes place in the south of France where Frank Martin (Ed Skrein) enters into a world full of trouble. His father Frank Senior (Ray Stevenson) goes to visit his son for a weekend without knowing what he will encounter. Frank is the Uber person that transports you wherever you want to go without any questions being asked.  He stumbles upon trouble when he is engaged by a cunning sinister women Anna (Loan Chabanol) and her three seductive sidekicks to orchestrate the bank heist of the century.  He must use his courageous skills with his super fast Audi and slick women to outrun a Russian kingpin. But, it is not over because the women want revenge.  This is the beginning.  That’s all I can reveal.

My favorite part is when Frank Martin and Anna and her three side chicks are leaving the club after they terrorized the patrons.  Frank gets into an altercation outside and puts all the women in the car and tells them not to touch anything.  While he is fighting, the car rolls down the ramp by itself.  It is awesome! I really enjoyed that part.

The message of the film is to love your children dearly, no matter how hard it gets and don’t ever give up on them for money.

I recommend this film for ages 13 to 18 and give it 3 out of 5 stars because it did not really keep my interest.  Also, I feel this is inappropriate film for children under the age of 13 but people older will appreciate it.

This movie is in theaters now so, if you’re over the age of 13, check it out.

The Transporters Refueled

I have to start this review off by saying that I have not seen the previous three previous Transporter films. I am reviewing this film as it stands on its own and not as the fourth sequel in the franchise so take my criticism with that in mind, for better or for worse.

With that said, I think this movie is very average. As a person who knows films and has seen plenty of action films, this movie offers nothing special. It has some nice moments, but there are plenty of mistakes that could have, and should have been, been avoided. What I do know from the series is that Jason Statham is replaced in this film so it is like a re-birth for a new era. If that is the case then, it’s not off to a great start. But, it’s not off to bad one either.

The best parts of the film are the action sequences. They are things of beauty, filled with excitement, vivacity and cool effects. There are good performances for a film of this kind, especially from Ray Stevenson. There’s even a nice twist towards the end.

But, there is an awful romantic subplot, with inconsistent characterization.  The fact is that this action movie is no different than any other action movie as you’ll see. It’s entertaining, yet forgettable.

For fans of the series, I’m sorry I can’t help you more. I liked it for the most part and I’m not a fan. So perhaps that means you’ll like it even more than me. I hope so.

I give it 2 1/2 out of 5 stars and recommend it for ages 15 to 18. Some of the content pushes its rating. Some of which had me question what the original cut looked like. This film is in theaters now.

I received a variety of samples and what I really love is how fresh this bread is! It’s lowfat but it also tastes great! One of my favorite is the 4 BFree Brown Seeded Rolls! You can check out the website for some really great recipes too!  I tried the Avocado Butter on a bagel..yum! I will be trying the other recipes soon! I was really quite surprised at the taste and highly recommend!

Carrington Farms Flax Burger Recipe for End of Summer

Although it is back-to-school time, it it still Summer! That means it is a great time for hamburgers!  This  flax burger recipe by Carrington Farms  is sure to be a hit! I tried it this past Labor Day and I really liked it! 

After eating standard burgers/cheeseburgers all season, this recipe puts a healthy spin on the traditional BBQ favorite, packs a ton of flavor and is rich in omega-3s, omega-6s, fiber, and lignans – serving plenty of nutrients with every bite.

Here’s the recipe:

Prep time: ~15 minutes
Ingredients:

  • 1 pound thawed ground beef, lean ground turkey or bison, veal or your favorite meat
  • 2 Tbs finely chopped onion
  • 1 clove garlic minced
  • 2 Tbs Carrington Farms Organic Milled flaxseed
  • 2 Tbs water
  • 3/4 cup soft bread crumbs (1 slice of bread)
  • 1 beaten egg
  • 1 Tbs mustard
  • 1/4 tsp sea salt
  • 1/4 tsp pepper
  • 4-6 hamburger buns

Directions

  • Mix together meat, onion, garlic, flax and bread crumbs
  • Lightly beat water and egg together and add to mixture. Add mustard, salt and pepper
  • Cook on a grill or stove top until no pink remains (~12 mins)
  • Optional cheeseburgers: top with slice of your choice of cheese at end of cooking and grill or broil for about 1 min

Makes 4 -3/4 inch thick patties or 6 -1/2 inch thick patties.

They really are quite tasty and I love that they are a healthier option!
